Utah's top DUI cop cited for DUI - Criminal Peculiarity - MSNBC.com

SALT LAKE CITY - The commander of the Utah Highway Patrol's drunken driving unit has been cited for driving under the influence of alcohol after crashing his cruiser into a concrete barrier, authorities said. The Lt. veered off the shoulder of a highway in Draper early June 23, overcorrected and hit the barrier that separates the lanes, Lt. Doug McCleve said Thursday. The Lt said he fell asleep at the wheel, but officers suspected he had been drinking, said Draper police Sgt. Scott Peck. The Lt. refused to submit to a breathalyzer test until two patrol captains talked to him, Peck said."

Seminole judges wrong to reject evidence, appeals court decides

SANFORD -- An appeals court on Wednesday handed accused drunk drivers a huge defeat. It ruled that judges who have thrown out virtually every breath-alcohol test in Seminole County in the past 18 months were wrong.The ruling affects more than 100 pending DUI cases currently on appeal in Seminole, said Assistant State Attorney Gino Feliciani, and restores one of the state's most powerful pieces of evidence. It's a piece that Seminole judges stripped from about 1,500 DUI cases. Four of Seminole's five county judges who hear those cases tossed every breath test that came before them when defense attorneys asked for the computer source code at the heart of the state's breath-alcohol test unit.

Can a person start drinking after the car with an Ignition Interlock gets started?

Re-tests are required as long as the engine is running. The re-test is random and if it's not taken or alcohol is detected above a preset limit, an alarm is activated and remains on until the driver passes the breath test or pulls over and shuts off the engine.

What stops someone else from starting the car with an Interlock for a drunk?

Nothing but it's not a simple exhale, most people have to be trained to use the device.

What happens if a person who has been drinking tries to start a car with Ignition Interlock?

If the alcohol level exceeds .05 the driver cannot start the car for five minutes. Two .05 or above readings in a three-hour period causes the 30 minute lockout. The data from the the breath tests are reported to the state.

"The Florida Highway Patrol is planning a sobriety safety checkpoint between 10 p.m. and 2 a.m. Friday on Navy Boulevard near the old Vince Whibbs dealership in Escambia County, according to a news release by Lt. Steve Preston. About 25 officers are participating, along with the Emerald Coast Mothers Against Drunk Driving, Escambia County deputies, Pensacola Police officers, and Santa Rosa County deputies."
