Florida Traffic Cameras - Florida Attorney


According to my friend an excellent traffic attorney, "From a legal standpoint, this decision seems to track the Minnesota Supreme Court decision which ruled that the State has exclusive jurisdiction for the creation of traffic regulatory laws.  Minnesota and Florida’s traffic code seem to be quite similar, so this would be predictable.  The [Third]  DCA is going to have to decide as to whether to maintain the integrity of this area of law, or provide a revenue stream for counties and municipalities."

Once the appeals are exhausted, the municipalities and counties will go to the legislature and ask for a law granting them authority to use these cameras.  When that happens, these tickets will be covered under [Florida Statutes Section 316] (they will carry points, and be required to be proven beyond a reasonable doubt).  Get ready to start defending these cases."

Florida Traffic Cameras in Legislature - Traffic Infraction Detectors

The Florida House and Senate will try to overrule a recent decision in Florida that outlawed use of red light traffic cameras. The proposed law provides in summary "for counties and  municipalities to enforce traffic control signals using traffic infraction detectors; requires reports from counties and  municipalities to department on use of traffic infraction detectors; provides for preexisting equipment. . . ." The Bill Is Titled "CS/HB 325 - Uniform Traffic Control" The Bill is so broad as to open the door for all types of robotic law enforcement on Florida's roads. We especially note the use of the term "traffic infraction detectors." The Bill also attempts to retroactively justify what the cities and counties and traffic camera manufacturers have done to avoid state traffic law limitations on these types of devices.

Voters Need to let their public officials know that generating revenue on the backs of drivers will not be supported at the ballot box.

Florida Red Light Cameras - Breaking News

A Florida Circuit Judge has ruled red light cameras are invalid. The Court ruled that a city cannot use red light cameras. The Court reasoned that only Florida's state Legislature can pass traffic laws. The ruling means that the city can regulate traffic issues of local concern, such as parking, but not red light controlled intersections.

Cities across Florida have tried to claim that a code violation is not the same as a traffic citation and that they have jurisdiction to create such rules. The court's ruling, if it withstands appeal means that an officer must be present to enforce red-light violations.

Some Traffic Cameras Being are being Fooled by Cloned License Plates. In Maryland, reports have surfaced of students making fake plates, speeding through intersections, then the Stop light traffic cameras photograph or video the incident and tickets are mailed to the owners of the plates.

In Europe this is referred to as plate cloning. The Maryland students call it the "speed camera pimping game."

Florida Red Light Cameras - Attorney Investigates - Scientific Report

Florida Red Light Camera Investigation Continues by a Board Certified Criminal Trial Lawyer - Scientists who have reviewed the safety of Florida Red Light Cameras concluded, "comprehensive studies conclude cameras actually increase crashes and injuries, provid[ing] a safety argument not to install them. Presently, Florida statutes do not permit red light camera evidence to be used as the sole basis for ticketing drivers for violating the law." Phd's at the University of South Florida have spoken. Here are the facts:

"Major evaluations were conducted in Greensboro, North Carolina; Virginia; and the Canadian province of Ontario. The studies used multiple years of before-and-after data at camera intersections and comparison (no camera) intersections resulting in consistent findings. Camera intersections were associated with a significant increase in crashes. Increased rear-end crashes were a particular problem and may occur as drivers attempt to stop abruptly in order to avoid a ticket."

If the science proves they are dangerous, then the question then becomes if not for safety, then why are Florida drivers being forced to pay millions in fines? Remember your public officials who have placed this hidden tax on Florida's drivers, when you go to the ballot box.
