DUI Florida Probable Cause - Stopping for Too Long?

A DUI Officer observed a defendant remain at a flashing red light for 41 seconds and then drove through intersection in a safe manner. The Court found that created only a mere suspicion , not a well-founded reasonable suspicion of criminal activity to justify the stop. The Court ruled that the DUI Officer had no justification to conduct safety stop. The court also ruled that the defendant was not exhibiting behavior that was dangerous to another person or vehicle and that the officer's safety suspicions that the DUI defendant was injured or his vehicle was malfunctioning should have been alleviated by defendant's normal driving technique and vehicle's obvious operation in driving through intersection. Motion to Suppress the stop and the subsequent suppression of all evidence collected thereafter should have resulted.

Tampa Defense Attorney - Drag Racing Statute Unconstitutional

Catching Street Racers just got a little tougher. Cops lost a valuable tool in the war on wheels. The street racing statute is unconstitutional according to the Fourth District Court of Appeals.

The court cleared a Broward teen who was driving 130 mph in a 65 mph zone. Officers couldn't determine who was racing, and who was just passing another car that was also speeding. "You could have two people driving down the turnpike next to each other at the same rate of speed, and based on the way the statute is written, this is what the court said, that they both could be charged with drag racing," says Elizabeth Parker with the State Attorney's office.


70-people have been busted for drag racing in Palm Beach County in the last year. The penalties are harsh - Up to a year in jail and an automatic license suspension.

Cops Crush Street Racer Cars

When the whoosh went out of the tires the street racer sighed, as glass exploded and rained down it all became real - the cops had crushed his car. The destruction was part of a smackdown on illegal street racing in Southern California. Cops crushed six racecars. A 350-horsepower 4 cylinder engine on which the racer spent at least $10,000 to get into top shape. The car would top out at 160 mph, the racer said, swearing it could beat a Corvette or even a Ferrari.

Pinellas County Watching Speeders From Chopper

DUI Pinellas ChopperThe sheriff's office "can be anywhere at any time" to catch speeders. They're watching bridges from above."The helicopter is up about 500 feet in the air and they're targeting vehicles," said Sgt. Ken Page from the sheriff's office. "They continue to follow that vehicle until we get the correct vehicle stopped." He targets speeders and issues a Traffic Citation that can be used as an intro to a DUI investigation.

A deputy in the helicopter is watching two white lines that are exactly 528 feet apart, one tenth of a mile. The sheriff's office uses special stop watches that calculate the average speed for that distance.
