Polk DUI Defense Attorney on Policy Violations


Polk DUI Defense Attorney, Lawyer W.F. ''Casey'' Ebsary follows up on an earlier story about creative report writing at the Polk County Sheriff's Office DUI Unit. It appears the punishment for DUI offenders is the possibility of jail and huge fines. The punishment for the wayward deputy, according to published reports, "a letter of guidance for his job . . . go to a report-writing class, and his reports will be periodically reviewed for 90 days."

DUI Halloween Tampa, Hillsborough County Florida

Tampa Bay DUI law enforcement predicts many DUI arrests, perhaps a record this holiday season starting with Halloween. Halloween falls Saturday , a first since 1998. Bars are open an extra hour since daylight saving time ends at 2 a.m. Sunday. People will get an extra hour until closing time. Those 2 factors equal increased opportunities for Driving Under the Influence charges. Other jurisdictions in Hillsborough, Polk, Pinellas, and Pasco counties can expect the same.

Florida DUI Checkpoint Results - 1000 Stops - Zero Arrests for DUI

Florida DUI Checkpoint Attorney LawyerA Florida DUI checkpoint nets 10 arrests. But, none of them were for DUI! The Florida Highway Patrol set up the checkpoint. There were actually 1,131 vehicles checked.

Here's the Tally:

Zero arrested for DUI
Two arrested on outstanding warrants.
Seven arrested on felony charges, including six on drug-related charges.
One arrested for misdemeanor drugs.

104 traffic citations issued.
10 faulty equipment warnings were issued.
10 warnings were issued.

DUI Florida Actual Physical Control

DUI Florida Attorney Lawyer TampaA Florida Deputy Sheriff reported that he found a woman inside the trunk of her broken down vehicle. The woman said she had put herself in her own trunk. She was not seen driving or behind the wheel, so police did not arrest her or charge her with DUI. Florida law 316.193 requires "actual physical control" a finding that the defendant was behind the steering wheel in order to be able to arrest the person for driving under the influence.

DUI Lakeland Attorney Florida Checkpoint

Lakeland Police are conducting DUI Checkpoints, including saturation patrols and checkpoints in Lakeland Thursday and Friday evenings. Florida Avenue, Brunnell Parkway, and Lake Miriam are targets. Over the Limit - Under Arrest is the code name for this operation.
