Florida Traffic Cameras in Legislature - Traffic Infraction Detectors

The Florida House and Senate will try to overrule a recent decision in Florida that outlawed use of red light traffic cameras. The proposed law provides in summary "for counties and  municipalities to enforce traffic control signals using traffic infraction detectors; requires reports from counties and  municipalities to department on use of traffic infraction detectors; provides for preexisting equipment. . . ." The Bill Is Titled "CS/HB 325 - Uniform Traffic Control" The Bill is so broad as to open the door for all types of robotic law enforcement on Florida's roads. We especially note the use of the term "traffic infraction detectors." The Bill also attempts to retroactively justify what the cities and counties and traffic camera manufacturers have done to avoid state traffic law limitations on these types of devices.

Voters Need to let their public officials know that generating revenue on the backs of drivers will not be supported at the ballot box.

Tampa Defense Attorney - Drag Racing Statute Unconstitutional

Catching Street Racers just got a little tougher. Cops lost a valuable tool in the war on wheels. The street racing statute is unconstitutional according to the Fourth District Court of Appeals.

The court cleared a Broward teen who was driving 130 mph in a 65 mph zone. Officers couldn't determine who was racing, and who was just passing another car that was also speeding. "You could have two people driving down the turnpike next to each other at the same rate of speed, and based on the way the statute is written, this is what the court said, that they both could be charged with drag racing," says Elizabeth Parker with the State Attorney's office.


70-people have been busted for drag racing in Palm Beach County in the last year. The penalties are harsh - Up to a year in jail and an automatic license suspension.

Cops Crush Street Racer Cars

When the whoosh went out of the tires the street racer sighed, as glass exploded and rained down it all became real - the cops had crushed his car. The destruction was part of a smackdown on illegal street racing in Southern California. Cops crushed six racecars. A 350-horsepower 4 cylinder engine on which the racer spent at least $10,000 to get into top shape. The car would top out at 160 mph, the racer said, swearing it could beat a Corvette or even a Ferrari.

Florida Visitors and DUI

Police officials claim seasonal residents are a main part of the problem. More people means busier bars. Police Officer Thom Carr says officers have had drunk driving cases where someone registered a .253 on a breathalyzer machine at 4 p.m. in the afternoon - more than triple the legal limit. Hundreds of cases involving breath-alcohol tests have been thrown out by Seminole County judges in the past five months because the test's manufacturer will not disclose how the machines work. All four of Seminole County's criminal judges have been using a standard that if a DUI defendant asks for a key piece of information about how the machine works - its software source code, for instance - and the state cannot provide it, the breath test is rejected, the Orlando Sentinel reported Wednesday. Prosecutors have said they do not know how many drunken drivers have been acquitted as a result. But Gino Feliciani, the misdemeanor division chief in the Seminole County State Attorney's Office, said the conviction rate has dropped to 50 percent or less."

The board has instituted many rule changes, eliminating certain crimes from the list disqualifying an applicant from applying for restoration of civil rights. For example, it allows restoration of rights without a hearing for offenses such as racketeering and felony DUI convictions that had required a hearing. "

"What is the Legal Limit?

In reality, there is no legal limit. In Florida, a person can be arrested and convicted of DUI after consuming any amount of alcohol.

So what does a Blood-Alcohol Level of .08 mean?

The term '.08 BAC' is commonly referred to as the legal limit, but this is not accurate. According to Florida Law, .08 BAC is the presumptive level of impairment. In other words, if you have consumed enough alcohol to reach a .08 BAC, you are automatically considered impaired.

What if I'm below .08 BAC?

You can still be convicted of DUI even if you are under .08 BAC. If your driving ability is proven to be impaired you will likely be convicted of DUI."
